Terms and Conditions for Art Commissions

These Terms and Conditions govern the contractual relationship between Soda Pop Illustrations and the client commissioning artwork for personal or commercial use. By commissioning the Artist, the Client agrees to these terms.2. Definitions
- Commercial Use: Use of Artwork for profit, advertising, merchandise, or business purposes.
- Personal Use: Non-commercial, private use (e.g., home display, gifts).
- License: Rights granted to the Client for Artwork usage, as specified in Section 6.3. Commission Process
- Request & Quote: Client submits a request; Artist provides a timeline, quote, and terms.
- Agreement: Commission begins upon Client’s acceptance and payment of full price or a non-refundable deposit depending on product.
- Payment: Full payment is due before final delivery. Accepted methods: Paypal, Venmo, Kofi, Cash App4. Scope of Work
- Revisions: 3 rounds of revisions included. Additional revisions at $5.
- Delivery: Final Artwork delivered digitally/physical via Discord / Email within a Week of finishing. Delays due to unforeseen circumstances (e.g., illness) will be communicated.
- Cancellation:
- By Client: Deposit forfeited; partial refunds for work completed at Artist’s discretion.
- By Artist: Full refund issued.
- Force Majeure: Neither party liable for delays/cancellations due to events beyond control (e.g., natural disasters).5. Intellectual Property
- Artist Rights:
- Retains copyright and moral rights unless explicitly transferred.
- May display Artwork in portfolios, social media, etc., unless agreed otherwise in writing.
- Client Rights:
- Personal Use: May display, print, or share Artwork with attribution. No resale, alterations, or commercial use without a Commercial License.
- Commercial Use: Requires a Commercial License granting specific rights (e.g., distribution, merchandise). License details (exclusivity, duration, territory) will be outlined in a separate agreement.
- Client may not register trademarks/copyrights for the Artwork without written consent.6. Confidentiality
Artist agrees to keep Client’s non-public information confidential unless required by law.7. Liability & Disclaimers
- Artist not liable for indirect damages (e.g., lost profits).
- Artwork is provided “as is”; Artist does not warrant non-infringement of third-party rights unless stated.8. Modifications
Terms may be updated with notice. Continued use constitutes acceptance.9. Severability
If one clause is invalid, others remain enforceable.10. Entire Agreement
Supersedes prior agreements. Modifications require written consent.Contact
